Tophost group entity, the details of which are indicated in the Tophost’s Terms of Service, ("Tophost") provides you web-hosting, domain name registration, and related products and service.
Tophost seeks to ensure the highest level of data privacy when offering its variety of quality products and services to Tophost customers and subscribers ("Subscribers") (collectively, “You”, or "Users").

We advise against posting any information you don’t wish to make public on the Tophost Platform. If you upload any content to your account or post it on your Website and provide it in any other way as part of the use of any Service, you do so at your own risk.

Information related to the calls or meetings you participate
In cases where you call Tophost or schedule an appointment for a meeting, such conversations will be recorded by Greenray - IT Turnkey Solutions LTD. for quality management purposes. As a result, we will be able to maintain and improve the quality of Tophost services based on Tophost quality standards and policies. For this purpose we will process the following data: email address, date and time of conversation, its duration, audio and/or video recording, any other personal data provided by you voluntarily during the conversation. Also, provided email address and / or phone No. may be used for the purposes of allowing you to reach us or contacting you regarding your matter.
In such cases processing is necessary for the purpose of the legitimate interests pursued by Tophost (under Article 6(1)( f) of GDPR) or is based on your consent, when you consent to video recording by turning video on, or provide certain data voluntary (under Article 6(1)(a) of GDPR).
The recordings will be kept up to for 30 days and deleted thereafter as soon as technically feasible.

We may collect, store and process certain information pertaining to visitors and users of our User’s websites or services, solely on our Users’ behalf and at their direction. We will share your Personal Data with companies, organizations or individuals outside our group of companies when we have your consent to do so.
11.2. Where do we process your personal data?
We may share non-personally identifiable information publicly as well as with our partners - publishers, advertisers. For example, we may share information publicly to show trends about the general use of our platform.
If we are involved in a merger, reorganization, acquisition or sale, we will continue to ensure the confidentiality of any Personal Data and give all affected Users appropriate notices.
Some of our servers are located outside EU or European Economic Area (EEA), such as US, India, Australia therefore, depending on your choice or the Services, your personal data as well as personal data of your users might be transferred to processors, sub-processors or other data recipients established in such third countries (i.e., data centers and servers, located outside EU or EEA). We will ensure that the said personal data will be transferred only if there is a sufficient basis for this under the GDPR and other applicable legal acts.
Standard contractual clauses for data transfers outside the EU or EEA. Other grounds for data transfers outside the EU or European Economic Area (EEA). Your personal data as well as personal data of your users might be transferred to data recipients established in third countries on other legal grounds compatible with the requirements of GDPR (Art. 45-49).
Transfer, disclosure of data to competent authorities. In certain situations, Tophost may be asked to disclose personal data in response to lawful requests by public authorities, other competent authorities, including when it is required to meet national security or law enforcement requirements, and will do so where permitted by local data protection laws.
11.3. Data Localisation Obligations
If you reside in a jurisdiction that imposes "data localisation" or "data residency" obligations (i.e., requiring that Personal Information of its residents be kept within the territorial boundaries of such jurisdiction), and this fact comes to our attention, we may maintain your Personal Information within such territorial boundaries, if we are legally obligated to do so.
You acknowledge that while doing so, we may continue to collect, store and use your Personal Information elsewhere.
11.4. Targeting, advertising
We also use Facebook, Google, as well as other advertising and marketing tools. You should carefully read the privacy policy of these service providers. 11.5. Social Media Features
Our Services include certain Social Media features and widgets, single sign on features, such as the "Facebook Connect" or "Google Sign-in", the "Facebook Like" button, the "Share this" button or other interactive mini-programs ("Social Media Features"). These Social Media Features may collect information such as your IP address or which page you are visiting on our Website, and may set a cookie to enable them to function properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Your interactions with these third parties' Social Media Features are governed by their respective policies.
11.6. Our Legal Obligation to Use or Disclose Personal Data
We will reveal your Personal Data to state and public authorities without your prior permission only when we are legally required to provide information, including taking legal action to defend our rights, as well as the cases, where we have a belief in good faith that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable law, regulation, legal process or enforceable governmental request, enforce applicable Terms of Services, including investigation of potential violations, detect, prevent or otherwise address fraud, security or technical issues.

We also regularly monitor our systems for possible vulnerabilities and attacks, and regularly seek new ways and Third-Party Services for further enhancing the security of our Services and protection of our Visitors' and Users' privacy.
Regardless of the measures and efforts taken by Tophost, we cannot and do not guarantee the absolute protection and security of your Personal Information, or any other User Content you upload, publish or otherwise share with Tophost or anyone else.
We therefore encourage you to set strong passwords for your User Account and avoid providing us or anyone with any sensitive information of which you believe its disclosure could cause you substantial or irreparable harm. We assume that all Users of Tophost Platform have carefully read this document and agree to its contents. If someone does not agree with this Policy, they should refrain from using our website, and mobile applications. We reserve the right to change our Policy at any time and inform by using the way as indicated in Section 17. Continued use of Tophost's website and mobile applications implies acceptance of the revised Policy.

Products purchased from Tophost may be refunded only if canceled within 30 days of the date of the transaction.
Note: Due to their nature, cryptocurrencies, tokens and digital assets are generally irreversible and their exchange rates are highly volatile and transitory. We can not be responsible for any risk including but not limited to exchange rate risk and market risk. Products purchased using cryptocurrencies, tokens or digital assets will not be refunded.
Note: If a client's actions are found to violate applicable laws or Tophost's Terms of Services, any payments made to Tophost will not be refunded.
“Date of the transaction”, for the purpose of this Refund Policy, means the date of purchase of any product or service, which includes the date any renewal is processed by Tophost in accordance with the terms and conditions of the applicable product or service agreement (Terms of Use). You may cancel a product at any time, but a refund will only be issued if cancellation is requested within the refund timeframe specified for the applicable product, if available at all. Note: Some products have different policies or requirements for a refund associated with them, including some products that are not eligible for a refund under any circumstance. Any products or services that were suspended, canceled, or terminated due to the abusive usage of the products, services, or any other violation of the Terms and Conditions are not eligible for a refund.
The purpose of the refund is for customers to try and understand whether the services provided by Tophost suit their needs. In any way, Tophost will not tolerate abusive usage of refunds (i.e., refunding the same services multiple times and (or) repetitively purchasing and asking for a refund for services purchased in bulk, etc.). Tophost remains a right to unilaterally decline the request for a refund if any of the signs related to the abusage of the refunds occur.
New Domain Name Registrations: Refundable if canceled and processed within four days of registration (96 hours), except .br (including .com.br and .net.br) domain.
.br (including .com.br and .net.br) domain registration is refundable if canceled and processed within seven days of registration.
Domain Name Transfers: Refundable only if the transfer is unsuccessful and (a) within four days of registration (96 hours) or (b) in case of .br (including .com.br and .net.br) domain, within seven days of registration

From time to time, TOPHOST offers special deals such as a free domain when buying 12/24/36 months hosting plan. Keeping in mind that there are different conditions for domain refunds (as described in this Refund Policy), Tophost remains the right to refund you a difference between your paid amount and the domain you received for free price. In such a case, you can keep using a domain name for the remaining billing period term.
Please note that all payment processors have different policies and requirements for refunds and there are some payment methods that are not eligible for a refund under any circumstance.

We provide refunds to the original funding source. But if you would like to use funds to purchase another Tophost service instantly, you can select a refund to your Tophost Balance. Please note that once a refund to Tophost Balance is initiated for a selected invoice, it becomes irrevocable and cannot be refunded to a different source.
Over-funded balance can be refunded within 30 days of the payment that resulted in the over-funding. In special cases, other payments can be refunded instead of the original payment if the 30-day time-frame can be applied to those payments.
If at any time, we record a decline, chargeback, reversal, payment dispute, risk of payment fraud or other rejection of a charge of any payable fees on your Tophost account (“Chargeback”), this will be considered as a breach of your payment obligations hereunder, therefore you agree that Tophost may pursue all available lawful remedies in order to obtain payment, including but not limited to, immediate termination, without notice to you, of your Tophost account and any domain names or Tophost services registered or renewed on your behalf (“Services”). In addition, this will also result in disabling the option to checkout with a credit card for your Tophost account to limit the risk of payment fraud.
In the event a Chargeback is performed, your Tophost account may be blocked without the option to re-purchase or re-use it, and any data contained in such a Tophost account, including any certain content, features, or capacity of your Tophost account may be subject to cancellation and loss of data.
Your use of the Tophost Services and the ability to checkout using credit card will not resume until you: verify the payment method used for the disputed transaction, either by providing: proof of the payment; or a simple censored photo of the credit card, with uncovered first 6 (six) and last 4 (four) digits. pay any applicable fees in full, including any fees and expenses incurred by Tophost and/or any third party services for each Chargeback received (including fees for Tophost Services provided prior to the Chargeback, handling and processing charges and fees incurred by the payment processor).
Cases related to criminal fraud chargebacks or obvious payment fraud (i.e. cases where compromised credit card details were used to make purchases) will result in permanent service termination without any option to recover.
If you have any questions or concerns regarding a payment made to Tophost, we encourage you to first contact our Customer Support team before filing a Chargeback or reversal of payment, in order to prevent the Tophost Services from being canceled and your Tophost account being blocked, and to avoid the filing of an unwarranted or erroneous Chargeback, which may result in your being liable for its applicable fees, in addition to re-payment of all the fees applicable to the Tophost Services purchased (and charged-back) by you.
We reserve our right to dispute any Chargeback received, including by providing the relevant credit card company or financial institution with any information and documentation proving that the User responsible for such Chargeback did in fact authorize the transaction and make use of the Services rendered thereafter.
We will investigate and record all reports of abuse submitted to us. Where appropriate, we may take action if a violation of any of our terms of service is confirmed or when required to do so if an activity violates the policies of ICANN or appropriate Registry. We may request additional information from you about your report. Kindly note that we retain the authority to disclose received abuse reports and associated information to the specific customer for the purpose of abuse resolution process optimization and preventing potential miscommunication. However, please note we may not be able to provide you with specific updates in response to your specific report due to privacy reasons. Proceedings under Paragraph 4 of this Policy will be conducted according to the Rules for Uniform Domain Name Dispute Resolution Policy (the "Rules of Procedure"), which are available at dispute policy, and the selected administrative-dispute-resolution service provider's supplemental rules.
By applying to register a domain name, or by asking us to maintain or renew a domain name registration, you hereby represent and warrant to us that (a) the statements that you made in your Registration Agreement are complete and accurate; (b) to your knowledge, the registration of the domain name will not infringe upon or otherwise violate the rights of any third party; (c) you are not registering the domain name for an unlawful purpose; and (d) you will not knowingly use the domain name in violation of any applicable laws or regulations. It is your responsibility to determine whether your domain name registration infringes or violates someone else's rights.
On Aug. 31, 2013, ICANN adopted the Expired Registration Recovery Policy, which requires registrars to disclose important information to Registrants and prospective customers about expiration notices, fees, and redemption procedures (for more information click here). This article contains links to all required elements in the new policy. Below information is based on .com domain names.
[1] What happens after domain names expire?Once a domain name expires, it goes through few stages before being released to the general public. Tophost sends 3 renewal emails to the Registered Name Holder prior to the expiration date. If the registrant pays the domain renewal invoice before expiration, the domain is renewed automatically.

A registrant may renew an expired domain name at no extra cost until the domain is in Renewal Grace Period. Afterwards, the original registrant can attempt to redeem the domain up until day 67. The redemption fee of the most domains currently is €50.00 + Renewal Fee + VAT (.com.co €180 + Renewal Fee + VAT, .frl €150 + Renewal Fee + VAT, .store €120 + Renewal Fee + VAT, .ws €120 + Renewal Fee + VAT) and is subject to change under the terms of the Domain Name Registration Agreement. If you do not redeem your domain name prior to the end of the Registry's Redemption Grace Period the Registry will release your name and it will become available for registration on a first-come-first-served basis. For certain ccTLDs (.ru, .dk, .hu, .nu, .pl and .se) there is no Redemption Grace Period.
For .com domain names, whose registrar is Tophost (Enom) (you can always check your domain name registrar information in WHOIS Lookup), you will have a 10-days Renewal Grace Period calculated from the domain expiration date, during which you may renew your domain name free of charge.If you fail to implement the renewal before the end of indicated period, the domain name will be deleted and you also run the risk of having your domain name being acquired by a third party. If you wish to restore a .com domain after the 10 days Renewal Grace Period, please contact our Customer Support to check if there are any possibilities for your domain name to be restored.
The process we, the registrar, follow for expired domain names depends on your domain name extensions and their renewal settings. Prior to expiration, we send two emails to remind you to renew your domain names.
If your domain names are set to automatically renew, we attempt to renew the registrations for you 30 days before expiration.
If you set your domain names to manually renew and you let your domain names expire, we notify you via email again on the day of expiration.
For expired .com, .net, .org, .info, .biz, .us, .name or .mobi domain name registrations, we hold your domain name for approximately 60-70 days before canceling it.

Please note that your participation in the Bug Bounty Reward Program (“Bug Bounty Program”) is voluntary and subject to the terms and conditions set forth on this page (“Program Terms”). By submitting a site or product vulnerability to Tophost you acknowledge that you have read and agreed to these Program Terms.
These Program Terms supplement the Terms of Service and Privacy Policy and any other agreement in which you have entered with Tophost. The terms of those Tophost agreements will apply to your use of, and participation in, the Bug Bounty Program as if fully set forth herein. If any inconsistency exists between the Terms of Service, Privacy Policy and these Program Terms, these Program Terms will prevail, but only with regard to the Bug Bounty Program.
To encourage responsible disclosures, Tophost commits that, if we conclude, in our sole discretion, that a disclosure respects and meets all the guidelines of these Program Terms, Privacy Policy and Terms of Service, Tophost will not bring a private action against you or refer a matter for public inquiry.
As part of your research, you shall not modify any files or data, including permissions, and shall not intentionally view or access any data beyond what is needed to prove the vulnerability.

In order to avoid abuse of shared credentials for testing they will not be provided. Bug Bounty Program participants will need to register a new account and order a single shared hosting plan by themselves. We will provide discount coupons for our Bug Bounty Program participants which will cover all expenses of a single shared hosting plan for one month. Participants interested in testing Tophost web applications should reach out to the security team at security@tophost.ie asking to claim a free discount coupon. Please don't forget to include your Hackerone profile name, email used for Tophost account registration and short notice that you're participating in a Bug Bounty Program through Hackerone and we will send you a coupon code which will cover all expenses of a single shared hosting plan for one month.

By providing a submission through HackerOne or agreeing to the Program Terms, you agree that you shall not publicly disclose your findings or the contents of your Submission to any third parties in any way without Tophost's prior written approval.

You may be eligible to receive a monetary reward (“Bounty Payment”) if: (i) you are the first person to submit a site or product vulnerability; (ii) that vulnerability is determined to by a valid security issue by Tophost's security team at their sole discretion; and (iii) you have complied with all Program Terms.
Bounty Payments, if any, will be determined by Tophost, in Tophost sole discretion. In no event shall Tophost be obligated to pay you a bounty for any Submission. All Bounty Payments shall be considered gratuitous.
All Bounty Payments will be made in Euro (€). You will be responsible for any tax implications related to Bounty Payments you receive, as determined by the laws of your jurisdiction of residence or citizenship.
Tophost will determine all Bounty Payments based on the risk and impact of the vulnerability. The minimum bounty amount for a validated bug submission is €100 Euro and the maximum bounty for a validated bug submission is €5000 Euro.
Tophost security team retains the right to determine if the bug submitted to the Bug Bounty Program is eligible. All determinations as to the amount of a bounty made by the Tophost Bug Bounty Team are final. Bounty Payment ranges are based on the classification and sensitivity of the data impacted, ease of exploit and overall risk to Tophost customers, Tophost brand and determined to be a valid security issue by Tophost's security team.
As a condition of participation in the Bug Bounty Program, you hereby grant Tophost, its and affiliates a perpetual, irrevocable, worldwide, royalty-free, transferrable, sublicensable (through multiple tiers) and non-exclusive license to use, reproduce, adapt, modify, publish, distribute, publicly perform, create derivative work from, make, use, sell, offer for sale and import the Submission, as well as any materials submitted to Tophost in connection therewith, for any purpose. You should not send us any Submission that you do not wish to license to us.
You hereby represent and warrant that the Submission is original to you and you own all right, title and interest in and to the Submission. Further, you hereby waive all other claims of any nature, including express contract, implied-in-fact contract, or quasi-contract, arising out of any disclosure of the Submission to Tophost. In no event shall Tophost be precluded from discussing, reviewing, developing for itself, having developed, or developing for third parties, materials which are competitive with those set forth in the Submission irrespective of their similarity to the information in the Submission, so long as Tophost complies with the terms of participation stated herein.
In the event (i) you breach any of these Program Terms or the Terms of Service of the Tophost; or (ii) Tophost determines, in its sole discretion that your continued participation in the Bug Bounty Program could adversely impact Tophost (including, but not limited to, presenting any threat to Tophost's systems, security, finances and/or reputation) Tophost may immediately terminate your participation in the Bug Bounty Program and disqualify you from receiving any Bounty Payments. Please follow these Program Terms.
Any information you receive or collect about Tophost, Tophost employees or any Tophost customer through the Bug Bounty Program (“Confidential Information”) must be kept confidential and only used in connection with the Bug Bounty Program. You shall not use, disclose or distribute any such Confidential Information, including, but not limited to, any information regarding your Submission and information you obtain when researching the Tophost sites, without Tophost's prior written consent. Any disclosure of Confidential Information outside of this requirement will result in immediate removal from the Bug Bounty Program.
In addition to any indemnification obligations you may have under the Terms of Service, you agree to defend, indemnify and hold Tophost, its affiliates and the officers, directors, agents, employees and suppliers of Tophost, harmless from any claim or demand (including attorneys’ fees) made or incurred by any third party due to or arising out of your Submissions, your breach of these Program Terms and/or your improper use of the Bug Bounty Program.
The Bug Bounty Program, including its policies, is subject to change or cancellation by Tophost at any time, without notice. As such, Tophost may amend these Program Terms and/or its policies at any time by posting a revised version on our website. By continuing to participate in the Bug Bounty Program after Tophost posts any such changes, you accept the Program Terms, as modified.

Tophost supports the protection of intellectual property. Whether you are the holder of a trademark, service mark, or copyright, Tophost is committed to helping you protect your legal rights. Therefore, we have established the following policies for considering trademark and/or copyright infringement claims.
Please refer to the Uniform Domain Name Dispute Resolution Policy (the "UDRP") if you have a concern or dispute about a registered domain name. Any dispute regarding the registration of domain names will need to be sent either to the registrant or to an ICANN-approved arbitration provider.
This Trademark/Copyright Infringement policy specifically excludes domain name disputes and has been established to allow reporting of possible violations involving other Tophost products and services.
1. To notify Tophost that there has been a copyright or trademark violation, please follow the specific instructions in (A) for filing a trademark claim, or (B) filing a copyright complaint.
2. If you are responding to a complaint of infringement, you will need to follow our Counter Notification policy in (C).

If you (the "Complaining Party") would like to submit a trademark claim for violation of a mark on which you hold a valid, registered trademark or service mark (registered with the appropriate intellectual property organization of your country; state registrations and registrations on the Supplemental Register are not considered valid for these purposes), Tophost requests that the Complaining Party substantiate such claim by providing the following information via email to abuse@tophost.ie. The words "Trademark Claim" should appear in the subject line of the email.

Upon receipt of the appropriate information identified in Section 1 above, for trademark claims, Tophost will initiate an investigation and forward the Complaining Party’s written notification to the alleged infringer. While Tophost is investigating the claim, Tophost, at its sole discretion and without any legal obligation to do so, may temporarily remove the allegedly infringing material, notify the alleged infringer it will lock down the domain name(s), redirect the DNS,and/or if it is solely stored on a Tophost server, temporarily remove or deny access to the allegedly infringing material.
3. If Tophost concludes that the Complaining Party has raised a legitimate trademark claim, it may, at its sole discretion and without any legal obligation to do so, continue to suspend the alleged infringer's Tophost account and/or if it is solely stored on a Tophost server, deny access to the allegedly infringing material. If Tophost concludes that the Complaining Party has not raised a legitimate claim, Tophost will restore access to the allegedly infringing material.
4. The Complaining Party should understand that Tophost, an affiliate of ICANN accredited registrar, and its customers are bound by the UDRP. Nothing in this Policy should be construed to supersede the UDRP, nor the obligation of Tophost and its customers to abide by it in the context of domain name disputes.

If the Complaining Party would like to submit a copyright claim for material on which you hold a bona fide copyright, Tophost requests that the Complaining Party substantiate such claim by providing the following information via email to abuse@tophost.ie . The words "Copyright Claim" should appear in the subject line of the email.
To be considered effective, a notification of a claimed copyright infringement must be provided to Tophost and must include the following information:
Counter Notification.If you have received a notice of copyright or trademark infringement that you wish to challenge based on a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled, you may provide Counter Notification by emailing abuse@tophost.ie and including the following:
Upon receipt of a Counter Notification as described in Section 1 above, Tophost shall promptly provide the Complaining Party with a copy of the Counter Notification, and inform such Party that it will cease disabling access to it in ten (10) business days. Tophost will replace the removed material and cease disabling access to it in not less than ten (10), nor more than fourteen (14), business days following receipt of the Counter Notification, unless Tophost first receives notice from the Complaining Party that such Complaining Party has filed an action seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on Tophost's system or network.
It is Tophost's policy to provide for the termination, in appropriate circumstances, of Tophost customers and account holders who repeatedly violate this policy or are repeat infringers of copyrighted works, trademarks or any other intellectual property.
